By accessing or using AIPropertyPro (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding contract between you and Elite Agentic Solutions LLC (“Elite Agentic Solutions LLC”, “we”, “us”).
AIPropertyPro provides AI-assisted real estate tooling (CMA drafts, listing descriptions, marketing emails, market summaries, and document templates for agents and homeowners). The Service is AI-assisted: outputs are generated by large language models and may contain errors, omissions, or material that requires human review.
You are responsible for: (a) keeping your account credentials secure; (b) all activity under your account; (c) the accuracy and lawfulness of inputs you submit; (d) reviewing, fact-checking, and verifying all AI-generated outputs before relying on or publishing them; and (e) complying with all laws applicable to your use of the Service and to any output you publish or share.
The Service, including its software, branding, and underlying models, is owned by Elite Agentic Solutions LLC or its licensors. You retain ownership of content you submit. Subject to these Terms and your payment of any applicable fees, Elite Agentic Solutions LLC grants you a non-exclusive, non-transferable license to use AI-generated outputs for your own personal or internal business purposes. You may not (i) resell access to the Service, (ii) use the Service to train competing AI models, or (iii) misrepresent AI outputs as human-authored when applicable law or your contracts require disclosure.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that AI-generated outputs are accurate, complete, current, safe, lawful, or fit for your particular use.
To the maximum extent permitted by law, the total aggregate liability of Elite Agentic Solutions LLC, its officers, employees, agents, and affiliates arising out of or related to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (US $100). In no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, or loss of goodwill, even if advised of the possibility.
You agree to indemnify and hold harmless Elite Agentic Solutions LLC from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of: (a) your use of the Service; (b) your inputs or published outputs; (c) your violation of these Terms; or (d) your violation of any law or third-party right.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Wilmington, Delaware, with one arbitrator. You and Elite Agentic Solutions LLC each waive the right to a jury trial and the right to participate in a class action, class arbitration, or representative proceeding. If the class-action waiver is held unenforceable, the entire arbitration clause is severable. Either party may bring an individual claim in small-claims court for disputes within that court’s jurisdiction.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to Section 8, any action not subject to arbitration must be brought exclusively in the state or federal courts located in Delaware.
You may stop using the Service at any time and delete your account from your account settings or by emailing us. We may suspend or terminate your access at any time, with or without notice, for any breach of these Terms or for conduct we reasonably believe is harmful to other users, the Service, or third parties. Sections 4–9 and 11 survive termination.
We may update these Terms from time to time. We will post the new effective date at the top of this page and, where required, provide notice through the Service or by email. Your continued use after the effective date constitutes acceptance.
